Title: Is this illegal?
Post by: coasterkrazy on November 11, 2006, 04:04:41 AM
Just curious, is it illegal to post a link to a rom hack? I mean, really roms are only illegal if you download them without owning them, but I can see where the Charas law would step in if I just posted mine in the games section, like I was about to do.

This is actually a false statement. The only way it's not illegal is if you made the ROM yourself, and use it in its stead. But yeah, I'd have to step in if you posted it there, bud.

Damn... thought so. Ok, pal.

EDIT: Wait, what about an IPS? One can apply it to a rom they find elsewhere, and it's not a rom itself... bah, I just wanna share this somehow.

Btw, why is what I said false? Every legal rom website out there says in big letters, "ONLY DOWNLOAD THESE IF YOU OWN THE GAME YOU ARE DOWNLOADING." And legal statements about downloading roms basically say they are allowed to be used for backup if you own the game, but you have to delete them if it is lost or stolen etc.

Well, I remember a discussion that we had here on charas awhile back, and someone said the same thing you did. In regards to what they said, someone else (might have been Osmose? I can't remember) said that it's illegal to own roms regardless of owning the original game. The only way it's actually legal is if you create the rom using the game that you have. The whole roms being legal thing was misinterpreted from what the statement really says, so overall, having roms is illegal.

Porn for minors is illegal.

That doesn't stop the internet.

Catch my drift?

No, it is legal to have the rom if you own it, but you have to have uploaded the rom yourself.

And I don't think you can have them both running at the same time.

Nothing seems certain here, except I'm definitely not posting the rom.

What about the IPS thing?

Posting an IPS patch is not illegal. Zophar has a crapload of them.

Posting a patched ROM, however, is. Despite the fact that millions of ROM sites say that it's legal if you own the game or if you delete it within 24 hours, it is illegal to do either - Nintendo themselves even clarify this on their own website (http://www.nintendo.com/corp/legal.jsp#roms). The only exception is if you make the backup yourself and only use it yourself.

I can't(read: probably shouldn't) say that I download ROMs myself, but I can tell you that I've beaten Chrono Trigger, Super Mario RPG, and Final Fantasy 6 without ever owning an SNES.  :D

Thanks for clarifying that.

So it's settled then. I shall post an IPS patch. :D

Chrono Triggar is easily my favorite 2D game.

Shame Shame.

Let me say this in relation to the Chrono Trigger thing: The only two games my sister had ever completed were Paper Mario and the Thousand Year Door, and Chrono Trigger. She ALMOST got to the end of Chrono Cross, but didn't complete it. She barely got anywhere in Final Fantasy 6,7,9, Vagrant Story, and quite a few other games. She refused to play most of the Final Fantasy titles because they had random encounters and Chrono Trigger didn't. :p

Awwwww, bummer. I don't know what it was, but it just bored me. I've finished tons of other RPGs, just not Chrono.

Definitely, an IPS patch would definitely be okay.
