If its copywrited then it isn't. Then again, everything you do with rpg maker is illigal, so I wouldn't worry about it too much.

Hell Yeah! Just recovered all my old rm2k/3 games from my 10 year old, broken laptop hard drive that had been formatted and had a new OS installed on it. Oh, and I did all of this from my phone. WIN

If you don't get it turned into an actual game and SELL it, then it doesn't matter. As long as you don't resale, then you can do whatever you want with it.

If it's a midi version of a theme then it's totally legal, since the midi counts as a sepeare entitly from the normal song and presumably the creator doesn't have a copyright.

If it's the actual mp3 quality song from a soundtrack or something it would not be legal if you are selling your game or anything related to the song for profit. Which with RPGMaker we can assume you're not.

In short, no one cares.
