Hello,
I found a char in the resources section. I would like if I can use it in a game which will be distributed with a book.
Technically, the game is freely distributed with the book.
Have I to ask the author?

Commercial RPG Maker game? LOL Ain't gonna happen, Skippy. RPG Maker is pretty basic, not allowing much customization without being awkward or tedious. Try learning to program. I am assuming that you're using RPG Maker. If you're just using the graphics, then you might have a chance. You have to make sure they aren't based off of any graphics used in full-fledged RPGs. Asking permission or giving credit isn't law, but if you don't and the graphics are obviously someone else's you'll seem like an ***hole.

I was talking about custom-made intercrap. Not stuff from real games.

So was i. As soon as someone makes something, it is copyrighted to them, and anyone else who wants to use it needs their permission.

My advice strongly is not to include the game with the book if you plan on selling the book for money. RPGMaker is a program for hobbies, not for making money. You would almost certainly get a Cease and Desist letter from Enterbrain if they found out demanding that you remove the game from your book. If you failed to comply, you would likely be facing a costly lawsuit. Ain't worth it.

You could include the game as a free download from your website as a "no purchase necessary" accessory to the book. That should get you around the fact you cannot sell other people's things for profit. Though I'm not sure if that would be considered an advertisement strategy and thus part of the profit. I'm not a lawyer. You might want to talk to one briefly about this situation. Yes, I'm serious.

Rm2k3 CANNOT be used for commercial games. It is illegally translated, and so there is no way you could sell a game made in it. Unless you bought the japanese version, which I HIGHLY doubt.
